Marriage can be hard enough some days. Throw money into the mix, and things can get downright ugly.  However, just as disagreements in other aspects of your married life don’t have to result in permanent rifts, disagreements over money don’t have to ruin your relationship.  As with all things in marriage, money issues need to be worked through. Here are some ideas for overcoming disagreements about money in marriage:


Know Thyself


One of the best things you can do is understand your relationship with money.  In order to articulate your position on money to your partner, you need to be able understand.  Think about why you spend (or save) money the way you do.  You should also come to grips with why you don’t like the way your spouse handles money, and determine whether or not your own preferences and money prejudices are coloring the situations.


Avoid Money Discussions When Angry


Before discussing money, make sure that you are both calm.  One way you can do this is to make an “appointment” to discuss money.  That way, you know to calm yourself beforehand.  Money discussions should take place when you are both as rested as possible (not after a long day of work) and when you are not hungry.  Try to find a comfortable location when discussing money, so that both of you are in a more forgiving frame of mind.


Listen to Your Partner


You and your spouse should take turns listening to each other’s ideas.  Listen without interrupting, except to ask clarifying questions.  Then, expect the same respect from your partner.  You should be able to explain your position as well.  If you both agree to listen respectfully, you will get a better idea of each other’s positions, and you will have something to work with when deciding what to do next.


Remember Your Big Picture Goals


Hopefully, you have some big picture goals as a couple.  When disagreeing about money, it is a good idea to pull out your shared goals for retirement, a vacation, kids’ college or your emergency fund.  Together, you can determine what actions will best help you reach your bigger shared financial goals.  Taking the time to re-connect to the commonalities you share will be a big help.


Let Each Person Control Some Money


You should each have control over some of the money.  This should be available for you to use how you want.  With separate spending abilities, it makes it possible for you buy what you want — even if your partner doesn’t agree.  Make it a rule that each spouse will respect what is done with the discretionary spending each has.


In some cases, the best idea is to have separate accounts if you have a hard time agreeing on what to do with money.  Make sure that each of you contributes to a central pot for household expenses, and then you can each have separate checking accounts.  However, even in such a setup, it is important to touch base and make sure you are still working toward shared money goals.


Be Willing to Compromise


Finally, you have to be willing to compromise.  Any relationship has some give and take, and you and your partner need to be ready to give up a little something.  With some thought and planning, it is possible to disagree about money without causing serious problems.

Have you noticed that your paychecks have been a bit larger than normal lately? That’s because in 2011, the government is cutting the social security payroll tax paid by individuals from 6.2% to 4.2%.


How much is that in stone cold cash? If your annual income is $40,000, that’s $800 over the course of the year divided among your bi-weekly or monthly paychecks. If you earn $80,000 annually, your extra pocket money is $1,600. For those who make $106,800 or above, you’ll see an extra $2,136. Since social security is taxed individually, married couples could get up to a $4,272 take home pay boost for the year.


Now, what should you do with your extra moolah? Sheryl Garrett, the author of the Personal Finance for Dummies Workbook, a Certified Financial Planner and founder of the Garrett Planning Network, suggests these 10 ways to wisely spend your money, in order of importance for increasing your financial standing for years to come.


Balance Your Budget


If you live paycheck to paycheck, or on a tight budget, the extra $66 per month (if your annual income is $40,000) could mean the difference in paying your electricity bill this month – or not. This month, balance your budget with the fatter paychecks. Next month, adjust your budget so your expenses and income balances when the payroll tax cut expires. Since this bonus money is a one-year deal, don’t rely on it next year to cover basic expenses. Focus on other expense-reduction strategies: negotiate your next lease, use coupons at restaurants, ditch buying grocery items that are spoiling in your fridge, or change your IRS withholding if you get a refund every year.


Settle old debts


“Wouldn’t it be nice to pay off your mom and dad for the money they lent you for an apartment deposit?” says Garrett. Use this money to pay off any money you borrowed from family or friends.


Pay Off Credit Cards (and keep them that way)


Credit cards are easiest to attack, since you see the bill each month. If you use Mint.com, you can set up a goal to pay down your credit-card debt, and Mint will prepare a customized plan for you based on your cards’ balances and interest rates.


Boost Your 401(k) Contributions


If you’re currently not taking advantage of the full amount your employer will match on your 401(k), use your extra cash here. Once you’ve fulfilled this amount, deposit any remaining funds in a Roth IRA.


Contribute to a Roth IRA


Unless your adjusted gross income is higher than $122,000 if you’re single, or $179,000 if you’re married, filing jointly, you are eligible to contribute up to $5,000 in a Roth IRA. (The contribution limit is $6,000 if you’re 50 or older.) If you haven’t already made that contribution for 2010, you have until April 18, 2011, to do so. You can also, of course, contribute another $5,000 for 2011. While the amount you contribute is not tax deductible, you’ll reap the benefits once you start making withdrawals: all your withdrawals, earnings included, are completely tax-free as long as you’ve held them for at least five years. (And, of course, you need to be 59 ½ or older to make penalty-free contributions.)


Buy Yourself Marketable Skills


Enhance your ability to earn money in any of a number ways. If you’re actively looking for a job, consider hiring a resume service to help polish your resume. If you’ve been thinking of going back to school, take your GRE or GMAT test. Take a continuing education course. Buy a snazzy suit for interviews. The key is to spend cash in a way that will boost your income, now or in the near future.


Invest in Your Health


If one of your New Year’s resolutions was to improve your health, now is the time to see a nutritionist. If you’re a smoker, join a stop smoking program. Buy a bicycle to save on gas, or caulk your windows or insulate home. With every investment, think: will this save me money next year by doing this action?


Shop for Organization Tools


Luckily, Mint.com and basic tax software is free, but consider upgrading to the non-free version if you have a home business or more complicated tax forms. If your important documents are scattered across the house, buy a file cabinet or an expandable file organizer. The better organized you are, the easier it will be to manage your money.


Take a Vacay


If you already have all these categories covered, take a vacation. A yoga retreat, cruise or weekend with your honey at a B&B may be just what you need to return home and spend quality time tweaking your budget to perfection.

Stock Making Money

The Barclays Short D Leveraged Inverse S&P 500 TR ETN (NYSEArca: BXDD), which is now trading at about $16 a share, would be automatically redeemed should its intraday indicative value fall to $10 or lower before the note matures, Barclays said in a press release. Barclays said it “temporarily suspended any further sales from inventory” of the notes. A Barclays official declined to elaborate.

“Based on the performance of the underlying index since the inception date of the notes, it is likely that a stop loss termination event may occur with respect to the notes,” the company said in a press release, adding that daily redemptions are not affected by its decision. A Barclays official declined to elaborate beyond the content of the press release.

The notes were trading at around $64 a share when they were launched in November 2009, and, again, are now trading around $16. The S&P 500, meanwhile, has risen 30 percent in the past year, fueled by the Federal Reserve’s loose monetary policy and cautious optimism that the U.S. is slowing digging itself out of its worst downturn since the 1930s.

For those who are long the BXDD and one day look at their brokerage accounts only to see a token amount of money where the ETF once was, here is the reason:



Warren Buffett’s Berkshire Hathaway Inc.  added to its holdings of Wells Fargo & Co.  in the fourth quarter, while eliminating positions in several other stocks including Bank of America Corp., according to a regulatory filing Monday.


Besides Bank of America, Berkshire sold all its shares of Becton Dickinson & Co., Comcast Corp. , Fiserv Inc., Lowe’s Cos. , Nalco Holding Co., Nike Inc.  and American depository receipts of Nestle SA.


The positions that Berkshire exited appeared to be part of the  portfolio of car insurer Geico Corp., long managed by Louis Simpson, who retired from the company late last year. Simpson, who is in his 70s, worked at Geico for more than 30 years and had autonomy over the subsidiary’s $4 billion stock portfolio.


The stock sales are part of a passing of the guard to Todd Combs, a former hedge-fund manager who is taking over a portion of the investment duties at Berkshire. The 40-year-old Combs, who recently joined Berkshire as an investment manager, is expected to get $2 billion to $3 billion to invest initially.


Berkshire’s $52.6 billion U.S. equity portfolio now includes just 25 stocks, the fewest in years. At the end of the third quarter, Berkshire held $48.6 billion in stocks after exiting investments in companies including CarMax Inc. , Home Depot Inc. and NRG Energy Inc., stocks that were in Geico’s accounts. The increase in the size of the portfolio reflects substantial gains in the value of major holdings, including Wells Fargo.


The Wells Fargo stake rose about 1.8 percent, to about 342.6 million shares. Berkshire is the San Francisco bank’s largest shareholder.


Buffett’s company, like other firms that control an investment portfolio of more than $100 million, is required to report its U.S. stock holdings 45 days after the end of a quarter, giving the public its freshest possible glimpse at the investing decisions of the “Oracle of Omaha.” The filing with the U.S. Securities and Exchange Commission is scrutinized by professional money managers and amateur investors alike, and Buffett’s stock picks have the power to move the shares of the companies he’s buying and selling.


But Buffett, Berkshire’s chairman and chief executive, has long warned investors who want to piggyback on his stock picks that not all moves in the portfolio are his.


Combs, tapped for the job in October, was a little-known manager of a Connecticut hedge fund called Castle Point.


Berkshire’s stakes in American Express Co. , Coca-Cola Co. and Kraft Foods Inc.  remained unchanged. Buffett’s firm appeared to remain the largest shareholder in each, though other money managers were also reporting the contents of their portfolios after the close of trading Monday, making an exact determination difficult.

Anybody can make money in their sleep, you jut have to put in a little bit of effort, marketing and time.

There are no secrets to success, and hardly any real overnight stories of people making millions overnight, having said that though it is still possible for your to make money while yo are sleeping, day or night. If you prepare, plan and put into action one of the ideas below, you should hopefully be earning money while you sleep.

Here are 3 ways you can make money while you sleep.

1. Create and sell an automated product.

How about creating and selling a fully automated product such an eBook. All you have to do is set up a simple website, write, create and then market your eBook, put it for sale, keep advertising and then it could possibly make you money while you sleep. You wont need to physically send anything out, or post anything, as your book and website are open 24/7. Make it fully automated so it does everything for you from accept the payment to send out the product in this case an eBook.

2. Earn Interest on your savings.

Your money could be making you more money without you having to even lift a finger. No matter how small or large your savings are, put any money you don't need immediately into a savings account and watch the interest build up, just lie back sleep and dream of your money making you money.

3. Be an affiliate.

If you have a blog or a website then you should try being an affiliate, pick a product you would like to sell, work out your potential commission for each sale you make, then get out there promote, advertise and sell. Again you will not have to send anything out, as you are just acting as a middle person between the buyer and seller, yet making money in the process. Set your affiliate product up so it is again fully automated, and who knows, somebody might have seen your advertising, want to visit your website, and buy a product your selling at 2am in the morning, hence this could be potentially making you money while you sleep.

So there you have it 3 ways you can make money while you sleep. There are many more ways to earn while you sleep, simply thing of products you can sell for others, or write and create these products yourself,. Produce or sell products that can be fully automated, so they require little effort to maintain once up and running.

Making Money Ideas





















The solution to a cash flow problem is often right at your fingertips. Fear and concern can keep us from piecing together answers that can make a significant difference. When cash-strapped clients call for a session, we turn over a few stones that are damming up their cash flow and often resolve the immediate problem with a few simple changes or action steps.

Some common oversights and mistakes made by business owners are directly related to a lack of confidence or self worth. Some are related to a fear of looking at, and understanding, their numbers and some are simply due to lack of experience or knowledge.  If you identify with any of these roadblocks reach out to someone who can help so you can put yourself firmly in the driver’s seat.  Here are a few ideas that might just get the cash flowing and profits moving.

Review your accounts receivable (AR) – Who owes you money? How long have these outstanding invoices been on the books and what are you doing to collect them? The longer you allow these invoices to remain unpaid the less chance you have of collecting on them. Small business owners are often afraid to “get too pushy” for fear of jeopardizing future business. Ask yourself if you really want to do business with someone who doesn’t value your services enough to pay you on a timely basis. Ask yourself if YOU value your services and how these outstanding invoices reflect on your own values. Remember, the efforts that you put into collections could be put toward marketing instead. But meanwhile, make some phone calls, send letters and, if necessary, have an attorney draft a letter for you and nudge the late pays into action.


Review your terms - What are the terms that you apply to your sales? Do your clients pay you upfront? Do they pay a portion in advance and have 30, 60 or 90 days to pay the balance? I once worked with a client who provided a service in the wedding industry. She collected 30% at the time the order was placed and the remaining balance on the wedding day. We changed her collection terms to 1/3rd upon booking, 1/3rd 30 days prior to the event and the 1/3rd on the day of the event. This simple adjustment really loosened things up for her and gave her a safety net.


Charge your worth – Okay, here’s the real issue for many soloists. Wow! I can’t count the times that I have heard people say they haven’t raised their fees in 10 years or that they feel sorry for people who can’t afford their services. There is nothing wrong with a little pro bono work, for sure, but please don’t end up in the poor house to compensate for someone else’s financial concerns.  If you do offer a reduction in fees or product cost communicate the terms clearly and make sure it’s not to your own detriment. Also, do a little competitive analysis by researching services and products similar to yours to see what the going rates are. Do you hear yourself making excuses to support your decision to charge lower rates? If so, talk to your accountant, coach, mentor or advisory board to gain perspective. Unless you are submitting RFP’s for government contracts the lowest bid doesn’t always win. Re-evaluate your pricing and make sure you are valuing your services and products as much as you hope that your clients will.

Evaluate your expenses – Another common cash flow issue is created by excess spending. For example, do you have contractors that you send jobs to because you want to keep them happy? We know that outsourcing is a priority so that your time is free to build your business, but if this is done to excess during a low revenue point it can backfire. I often hear concerns like, “Janie has been doing work for me for years and I can’t cut down on her hours.”  Yes, it’s difficult when you feel responsible for a portion of someone else’s income, but in the long run these temporary cuts will keep you in the black long enough to rebuild and move forward in a stronger position so that you can resume sending work their way. 

In this down economy, some soloists are holding on to office space that may no longer be necessary. If you need to make cuts like this, look for the advantages and give yourself a timeframe to work within. If you have a plan that you believe will turn things around, schedule a date to reevaluate your spending. It’s easy to get caught up in the “what if’s” when we are making decisions like letting go of an office. What if things turn around? What if my clients find out? Make a list of your pros and cons and understand your financial limits. Removing the stress of added expenses will help you to focus more clearly on solutions and growing your business.

The latest name spinning on the pinstripe rumor mill is five-time All-Star and 10-time Gold Glove winner Andruw Jones.
 
Don’t get excited just yet Yankee fans, as Jones is far cry from the star he once was as an Atlanta Brave.
 
Currently, Jones is a 33-year-old, washed-up center-fielder who sat atop the most elite of hitters list from 1997-2007.
 
Since leaving Atlanta at the end of the 2007 season, Jones signed a two-year, $36.2 million dollar contract with the Los Angeles Dodgers.
 
After batting .158 with three home runs, 14 RBI and 72 strikeouts in 209 at-bats, Jones was released after his first season. Jones only played in 75 games, as he had season-ending knee surgery.
 
The Rangers signed Jones to a minor-league deal in 2009, where he hit 17 home runs and 43 RBI in 82 games and finished with a .214 batting average.
 
Next up, the Chicago White Sox took a chance, as Jones posted a .230 batting average, with 19 home runs and 48 RBI in 107 games.
 
I think the scariest stat is that in Jones’ last three seasons, he has struck out 221 times in his 768 at-bats. That translates into a strikeout every fourth time Jones records an official at-bat.
 
This is another desperate stretch by GM Brian Cashman to add a cheap player who could be motivated back to greatness on the Yankees.
 
Jones is still at an age where he could be darn good, as he is younger than both Derek Jeter, Alex Rodriguez and numerous other players who are still thriving.
 
This means it’s attitude, not skill, that tripped up Jones, and that is much worse because he didn’t care to work anymore.
 
Look, it is never a good sign when a team pays a player to leave, especially one with Jones’ unspoiled history of 10 years with 25+ home runs.
 
Cashman keeps telling Yankee fans to be "patient," but this is just another stupid attempt with minimal hopes to save his own ass.
 
Now, the New York Yankees have successfully been tied to every known name free agent in this whirlwind of a failed offseason.
 
What boggles my mind is why the Yankees have not signed the league's best closer from 2010, Rafael Soriano, yet.
 
If Cashman claims he won’t give up the draft pick for Soriano, I guess the Yankee motto of “winning now” is no longer the theme.
 
Well, might as well lose another big-time arm because of the cost, but if Cashman thinks Jones or Colon will turn to gold, he needs to get his head checked.
 
The Yankees have the money, so what the hell is the problem? Not getting a free agent for fear of losing a draft pick surely doesn't sound like the Cashman I have known. Must be Hal and Hank making a business decision again without thinking.
 
All I can say to Brian Cashman and company is this: We Yankee fans still want to win in 2011, so why don’t you?

Making Money System


Flash game developers, who are like the plankton in the food chain of the video game industry, are more and more interested in developing games for Google’s Android mobile operating system, according to a new Flash Game Market survey.


The survey shows that the Flash game development community is becoming more mature and financially savvy, as the developers are focusing on the markets with the most potential for growth. It was produced by Mochi Media, which helps developers monetize their games, as well as Flash creator Adobe and FlashGameLicense.com. The survey of nearly 1,400 developers also shows that flash developers are open to getting their games on all sorts of new platforms in the name of reaching the widest number of users.


While 10 percent of the developers said they are currently developing on Android, more than 52 percent said they planned to begin doing so in the next year. That’s a big change from last year, when about 42 percent said they planned to make games for the iOS, or Apple’s iPod Touch, iPhone and iPad devices. Android has come on strong in the past year, toppling Nokia as the world’s leader in smartphones in the fourth quarter.


Flash gaming is also growing in popularity internationally, leading to new markets and talent pools. About 19 percent of the developers are from the U.S., down 15 percent from a year ago. About 8 percent are in the United Kingdom, and six percent are in the Russian Federation. Canada accounts for 5 percent, Ukraine is 4 percent, India is 4 percent, and Brazil is 3 percent.


Developers are making money through a lot of different means. Sponsorships are now the main source of revenues. The number of developers who report making money through sponsorships, licenses and custom game development increased 37 percentage points from the 2009 survey, jumping from 46 percent to 83 percent. In-game ads are also still popular, with 45 percent of developers taking advantage of this revenue stream.


The big change, Mochi Media product manager Colin Cupp said, is that developers now have access to many different types of monetization. Developers are also more experienced. About 27 percent have been making games for two to five years, and another 12 percent have been making Flash games for more than five years. About 8 percent of developers and publishers have published more than 21 games. But 63 percent have made five or fewer games.


“They can distribute their games and reach more people,” Cupp said. “They’re more sophisticated.”


About 60 percent of developers say they now make Flash games full-time, compared to 50 percent a year ago. Also, those developers are growing up into publishers, with 21 percent of companies now doing both development and publishing. Only 4 percent are just publishers. Some 75 percent say they are developers only, roughly the same as a year ago. In general, there’s still a shortage of Flash game developers, Cupp said.


About 97 percent of the developers are male and 75 percent of the developers are under 35. The largest age group is 25 years old to 35, which accounts for 43 percent of the population. A lot of the effort is solitary, with 57 percent of developers saying they make their games alone.


About 75 percent of games are made in less than three months. And 25 percent are made in less than a month.


But it’s still tough being a Flash game publisher. About 63 percent of Flash game sites get less than 200,000 visitors per month. About 32 percent of developers say that their games are played 200,000 times or less in their lifetimes. Only a lucky 3 percent say that their games have been played more than 10 million times. About 50 percent of developers say they make less than $500 a month from developing games. About 5 percent make more than $5,000 a month.

Some of the legal questions related to the individual mandate are, at least partially, policy questions. In particular, what does the individual mandate do? And can the law stand without it?



The argument conservatives are making right now is that the individual mandate regulates "economic inactivity." That's not a description anyone had heard of it back when conservatives were co-sponsoring bills with the individual mandate, and it's not what the policy's creator had in mind when he developed it. But that doesn't make it untrue.



To believe it, however, you need to adopt a very narrow definition of what's being affected here: Namely, the decision to purchase or not purchase health-care insurance. The more traditional view is that the individual mandate is one of a slew of rules and regulations bringing order to something much broader: The American health-care system, which all of us participate in. That's the view of the 38 health economists and academics who signed this brief (pdf). "There is no such thing as 'inactivity' or non-participation in the health care market," they wrote. "As the District Court" -- which ruled for the Affordable Care Act -- "recognized, virtually all Americans will, at some time during their life, require health care, either because of illness, accident, or the wear and tear of age."



Because health services are so expensive, the costs are defrayed over many years. That's what insurance does. And because we are a humane society, we have rules and regulations in place to ensure that people can get treated even if they don't have insurance. In that way, you may not be interested in the health-care system, but if you get hit by a bus, the health-care system is interested in you -- and that's true even though you weren't making an economic choice to become "active" in the health-care system when you stepped into the street. You were, by virtue of our laws and regulations and taxes, already an active participant. The authors of the brief make this point -- and its connection to the individual mandate -- well:



The requirement to obtain a minimal level of health insurance is predicated on the unique characteristics of the health care market -- the unavoidable need for medical care; the unpredictability of such need; the high cost of care; the inability of providers to refuse to provide care in emergency situations; and the very significant cost-shifting that underlies the way medical care is paid for in this country. Those characteristics do not obtain in other markets and, without them, the predicate for the kind of regulation adopted in Section 1501 does not exist. Hence, affirming Congress’ power to adopt Section 1501 will not open the door to unfettered expansion of federal power over individual liberty, as Appellants fear.



To make this more concrete, when an uninsured person breaks a leg and needs hospital care, that care is paid for by the rest of us. It'd be a bit odd for your economic inactivity to cost me money. But your decision to remain without insurance does cost me money, because you're an active consumer of health-care risk and an active participant on a health-care market that affords you certain benefits. When you don't purchase insurance, you've not decided against participating in the American health-care system. You're just not participating responsibly. To quote Mitt Romney:

Some of my libertarian friends balk at what looks like an individual mandate. But remember, someone has to pay for the health care that must, by law, be provided: Either the individual pays or the taxpayers pay. A free ride on the government is not libertarian.



Then there's the question of severability -- can the law work without the mandate? The legislation does not specifically say that it can. And the Obama administration, in a calculated gamble to persuade the Court that the mandate passes constitutional muster through the "necessary and proper" clause, is currently arguing that it can't. This, at least in part, led Judge Vinson to void the entire bill. "In the final analysis, this Act has been analogized to a finely crafted watch,and that seems to fit," he wrote. "It has approximately 450 separate pieces, but one essential piece (the individual mandate) is defective and must be removed. It cannot function as originally designed."



The irony of all this is that one of the central arguments in the Democratic campaign for the presidency was between the Obama campaign, which didn't think health-care reform required an individual mandate, and the Clinton campaign, which thought it did. I was on Clinton's side in that debate, but the case is more nuanced than the Obama team allowed then or is admitting now. The legislation will work much better with an individual mandate. But many people will be covered, and many goals achieved, in the absence of the mandate.

While 10 percent of the developers said they are currently developing on Android, more than 52 percent said they planned to begin doing so in the next year. That’s a big change from last year, when about 42 percent said they planned to make games for the iOS, or Apple’s iPod Touch, iPhone and iPad devices. Android has come on strong in the past year, toppling Nokia as the world’s leader in smartphones in the fourth quarter.


Flash gaming is also growing in popularity internationally, leading to new markets and talent pools. About 19 percent of the developers are from the U.S., down 15 percent from a year ago. About 8 percent are in the United Kingdom, and six percent are in the Russian Federation. Canada accounts for 5 percent, Ukraine is 4 percent, India is 4 percent, and Brazil is 3 percent.


Developers are making money through a lot of different means. Sponsorships are now the main source of revenues. The number of developers who report making money through sponsorships, licenses and custom game development increased 37 percentage points from the 2009 survey, jumping from 46 percent to 83 percent. In-game ads are also still popular, with 45 percent of developers taking advantage of this revenue stream.


The big change, Mochi Media product manager Colin Cupp said, is that developers now have access to many different types of monetization. Developers are also more experienced. About 27 percent have been making games for two to five years, and another 12 percent have been making Flash games for more than five years. About 8 percent of developers and publishers have published more than 21 games. But 63 percent have made five or fewer games.


“They can distribute their games and reach more people,” Cupp said. “They’re more sophisticated.”


About 60 percent of developers say they now make Flash games full-time, compared to 50 percent a year ago. Also, those developers are growing up into publishers, with 21 percent of companies now doing both development and publishing. Only 4 percent are just publishers. Some 75 percent say they are developers only, roughly the same as a year ago. In general, there’s still a shortage of Flash game developers, Cupp said.


About 97 percent of the developers are male and 75 percent of the developers are under 35. The largest age group is 25 years old to 35, which accounts for 43 percent of the population. A lot of the effort is solitary, with 57 percent of developers saying they make their games alone.


About 75 percent of games are made in less than three months. And 25 percent are made in less than a month.


But it’s still tough being a Flash game publisher. About 63 percent of Flash game sites get less than 200,000 visitors per month. About 32 percent of developers say that their games are played 200,000 times or less in their lifetimes. Only a lucky 3 percent say that their games have been played more than 10 million times. About 50 percent of developers say they make less than $500 a month from developing games. About 5 percent make more than $5,000 a month.

Some of the legal questions related to the individual mandate are, at least partially, policy questions. In particular, what does the individual mandate do? And can the law stand without it?



The argument conservatives are making right now is that the individual mandate regulates "economic inactivity." That's not a description anyone had heard of it back when conservatives were co-sponsoring bills with the individual mandate, and it's not what the policy's creator had in mind when he developed it. But that doesn't make it untrue.



To believe it, however, you need to adopt a very narrow definition of what's being affected here: Namely, the decision to purchase or not purchase health-care insurance. The more traditional view is that the individual mandate is one of a slew of rules and regulations bringing order to something much broader: The American health-care system, which all of us participate in. That's the view of the 38 health economists and academics who signed this brief (pdf). "There is no such thing as 'inactivity' or non-participation in the health care market," they wrote. "As the District Court" -- which ruled for the Affordable Care Act -- "recognized, virtually all Americans will, at some time during their life, require health care, either because of illness, accident, or the wear and tear of age."



Because health services are so expensive, the costs are defrayed over many years. That's what insurance does. And because we are a humane society, we have rules and regulations in place to ensure that people can get treated even if they don't have insurance. In that way, you may not be interested in the health-care system, but if you get hit by a bus, the health-care system is interested in you -- and that's true even though you weren't making an economic choice to become "active" in the health-care system when you stepped into the street. You were, by virtue of our laws and regulations and taxes, already an active participant. The authors of the brief make this point -- and its connection to the individual mandate -- well:



The requirement to obtain a minimal level of health insurance is predicated on the unique characteristics of the health care market -- the unavoidable need for medical care; the unpredictability of such need; the high cost of care; the inability of providers to refuse to provide care in emergency situations; and the very significant cost-shifting that underlies the way medical care is paid for in this country. Those characteristics do not obtain in other markets and, without them, the predicate for the kind of regulation adopted in Section 1501 does not exist. Hence, affirming Congress’ power to adopt Section 1501 will not open the door to unfettered expansion of federal power over individual liberty, as Appellants fear.



To make this more concrete, when an uninsured person breaks a leg and needs hospital care, that care is paid for by the rest of us. It'd be a bit odd for your economic inactivity to cost me money. But your decision to remain without insurance does cost me money, because you're an active consumer of health-care risk and an active participant on a health-care market that affords you certain benefits. When you don't purchase insurance, you've not decided against participating in the American health-care system. You're just not participating responsibly. To quote Mitt Romney:

Some of my libertarian friends balk at what looks like an individual mandate. But remember, someone has to pay for the health care that must, by law, be provided: Either the individual pays or the taxpayers pay. A free ride on the government is not libertarian.



Then there's the question of severability -- can the law work without the mandate? The legislation does not specifically say that it can. And the Obama administration, in a calculated gamble to persuade the Court that the mandate passes constitutional muster through the "necessary and proper" clause, is currently arguing that it can't. This, at least in part, led Judge Vinson to void the entire bill. "In the final analysis, this Act has been analogized to a finely crafted watch,and that seems to fit," he wrote. "It has approximately 450 separate pieces, but one essential piece (the individual mandate) is defective and must be removed. It cannot function as originally designed."



The irony of all this is that one of the central arguments in the Democratic campaign for the presidency was between the Obama campaign, which didn't think health-care reform required an individual mandate, and the Clinton campaign, which thought it did. I was on Clinton's side in that debate, but the case is more nuanced than the Obama team allowed then or is admitting now. The legislation will work much better with an individual mandate. But many people will be covered, and many goals achieved, in the absence of the mandate.
